Terms of Service

1. Acceptance of Terms
By accessing or using the CivicRides platform, mobile applications, website (civicrides.com), or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
CivicRides reserves the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
2. Description of Service
CivicRides is a community-centered mobility platform that connects riders who need transportation with drivers who provide it. The Service includes:
- On-demand ride booking and dispatch
- Advance trip scheduling
- Real-time GPS-based routing and navigation
- In-app fare estimation and payment processing
- Driver and rider ratings
- SMS and push notification communications
CivicRides is a technology platform and does not provide transportation services directly. Drivers are independent contractors, not employees of CivicRides.
3. Eligibility
You must be at least 18 years old to create an account and use the Service. By registering, you represent that you are of legal age and have the authority to enter into these Terms.
4. Account Registration
To use the Service, you must create an account with accurate, complete information including your name, email address, phone number, and (for riders) a valid payment method. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
5. SMS Communications and Consent
By providing your phone number and creating an account, you expressly consent to receive SMS text messages from CivicRides. These messages include but are not limited to:
- Account verification codes
- Trip confirmations and status updates
- Driver arrival and trip completion notifications
- Safety alerts and PIN verification messages
- Account and payment notifications
Message frequency varies based on your usage of the Service. Message and data rates may apply depending on your mobile carrier plan. You may opt out of non-essential SMS communications at any time by replying STOP to any message or contacting us (contact email will be available soon). Opting out of transactional messages (verification codes, active trip updates) may limit your ability to use the Service.
CivicRides uses Twilio as its SMS service provider. By consenting to receive messages, you acknowledge that your phone number will be shared with Twilio for the purpose of delivering these communications. See our Privacy Policy for details on how your data is handled.
6. Rider Terms
6.1 Booking and Cancellation
When you request a ride, you agree to pay the fare displayed at the time of booking. Fares are calculated based on distance, duration, time of day, and applicable tolls. Cancellation fees may apply if you cancel after a driver has been assigned.
6.2 Payment
Riders must maintain a valid payment method on file. All charges are processed through Stripe, our third-party payment processor. By adding a payment method, you authorize CivicRides and Stripe to charge your payment method for fares, tips, tolls, and any applicable fees.
6.3 Rider Conduct
Riders must treat drivers with respect, wear seatbelts, refrain from smoking or vaping in vehicles, and comply with all applicable laws. Abuse or harassment of drivers will result in account suspension or termination.
7. Driver Terms
7.1 Independent Contractor Status
Drivers using the CivicRides platform are independent contractors, not employees. Drivers are responsible for their own taxes, insurance, vehicle maintenance, and compliance with local regulations.
7.2 Driver Requirements
Drivers must maintain a valid driver's license, vehicle registration, and insurance. All drivers are subject to background checks and vehicle inspections. CivicRides reserves the right to deactivate any driver who fails to meet safety or quality standards.
7.3 Earnings and Payouts
Driver earnings are calculated per trip based on the fare structure for the applicable city and service type. Payouts are processed weekly via direct deposit through Stripe Connect. CivicRides retains a platform fee from each trip.
8. Safety
CivicRides is committed to safety. All trips include GPS tracking, PIN verification, and a safety checklist. Users may report safety concerns at any time through the app or by contacting us (contact email will be available soon).
9. Limitation of Liability
CivicRides provides the platform “as is” and makes no warranties regarding the availability, reliability, or accuracy of the Service. To the maximum extent permitted by law, CivicRides shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
10. Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in Pima County, Arizona, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or participation in a class action.
11. Termination
CivicRides may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or behavior that poses a safety risk. You may deactivate your account at any time by contacting us (contact email will be available soon).
12. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.
